Thank you for choosing JobGen! Our aim is to facilitate efficient and transparent hiring processes for both job seekers and employers. These Terms of Service ("Terms") govern your use of JobGen's websites, software, and services (collectively referred to as "Services"). Your agreement is with JobGen Inc. Please note that our Privacy Policy and GDPR Compliance details are available to explain how we handle your data.
By accessing and using our Services, you are agreeing to be bound by these Terms and our Privacy Policy. Your acceptance of these Terms is indicated by clicking or tapping on a button that signifies your agreement, by executing a document referencing these Terms, or by simply using the Services.
If you are signing up for the Services on behalf of an organization, you confirm that you are authorized to represent that entity, accept these Terms on its behalf, and that any reference to "you" in these Terms refers to the organization and its authorized personnel.

Your Data & Your Permissions
1. Ownership of Your Data When you use our Services, you provide us with various data, such as files, content, messages, and contacts ("Your Data"). Your Data belongs to you, and you retain all intellectual property rights to it. JobGen does not claim ownership over Your Data. These Terms do not grant us any licenses or rights to Your Data except for the limited rights required to provide the Services, as described in these Terms.
2. Limited License to Your Data To provide you with features like data hosting, backup, sharing, and collaboration, you grant JobGen a worldwide, royalty-free license to use, reproduce, distribute, modify, adapt, create derivative works, and make Your Data publicly available. This license is limited to the purpose of providing the Services to you and as permitted by our privacy policies. It continues even after you stop using our Services, but only for aggregate and de-identified data derived from Your Data.
3. Customer Lists JobGen may identify you as a customer on our website and in promotional materials. Any benefits arising from the use of your name and logo will be for your advantage.
4. Copyright We respect intellectual property rights. If you believe that Your Data has been exploited in a way that constitutes copyright infringement, you can notify JobGen's Copyright Agent.

Acceptable Use Policy
1. User Content You are responsible for the content you provide through our Services and must ensure you have the necessary rights and permissions for such content. You agree not to misuse our Services, including not attempting to probe, breach, interfere, spam, send altered information, or engage in other prohibited activities as outlined in this policy.

2. Content Review JobGen may review content for compliance with legal obligations and these Terms. We may modify, prevent access to, or delete content that violates the law or our Terms, but we have no obligation to monitor or review content.
3. Third-Party Resources We may link to third-party websites in our Services, but we do not endorse or review these sites. Trademarks displayed in our Services are the property of their respective owners.

Account Management
1. Keep Your Password Secure You are responsible for safeguarding your account credentials, and you must notify JobGen of any unauthorized access to your account.
2. Keep Your Details Accurate Maintain accurate contact and payment details associated with your account.
3. Remember to Backup You are responsible for backing up Your Data, and JobGen is not liable for data loss.
4. Customer Success JobGen may assign you a customer success manager to help you effectively use our Services.
User Requirements
1. Legal Status You must have the legal capacity to enter into a contract with JobGen. Organizations warrant their validity and authority to accept these Terms.

2. Minors Our Services are not intended for use by minors, and you represent that you are not a minor in your jurisdiction.
3. Embargoes You may only use our Services if not prohibited by applicable laws.
JobGen IP
JobGen Services are protected as our intellectual property, and these Terms do not grant you any rights in our Services, content, trademarks, or brand features.

Payment Terms
1. Fees for Services You agree to pay the fees for Services in accordance with the pricing presented to you. We bill you based on your chosen billing method and expect accurate payment information.
2. Subscriptions Some Services are billed on a subscription basis. You may cancel auto-renewal at any time. Refunds are only issued as required by law.
3. Taxes You are responsible for paying applicable taxes associated with your purchase.
4. No Refunds Refunds are only issued as legally required.
5. Downgrades Failure to pay may result in suspension or removal of paid features.
6. Changes JobGen may change fees with advance notice. Continued use of Services after changes constitutes acceptance.

Termination
1. Termination by You You may stop using our Services at any time, subject to the terms of cancellation and potential refunds.
2. Termination by JobGen We reserve the right to suspend or terminate your access for various reasons, including breach of these Terms or inactivity.
3. Immediate Termination Immediate termination may occur in specific circumstances outlined in these Terms.
Discontinuation of Services We may discontinue Services under certain circumstances, with prior notice to allow you to export Your Data.
Beta Services We may offer Beta Services for testing and feedback, and you agree to keep such services confidential.
Services "AS IS" We do not provide warranties beyond what is legally required.
Limitation of Liability JobGen is not liable for certain types of damages, subject to applicable laws.
Entire Agreement These Terms replace any prior agreements and do not create third-party beneficiary rights.
Waiver, Severability & Assignment JobGen's failure to enforce a provision is not a waiver. Unenforceable provisions will be substituted, and you may not assign your rights.
Modifications We may update these Terms to reflect legal changes or improvements to our Services, with advance notice.
Contracting Entity These Terms are governed by Sri Lankan law, and any disputes will be resolved according to applicable laws. Please try to resolve disputes informally before resorting to legal action.

Governing Law and Jurisdiction These Terms are governed by the laws of Sri Lanka, and any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Colombo, Sri Lanka. 18. Resolving Disputes In an effort to address concerns without legal action, we request that you attempt to resolve any disputes informally by contacting us at [email protected]. We will make reasonable efforts to resolve the issue amicably. If a resolution cannot be reached within 15 days, then further action may be considered.
19. Modifications We may periodically revise these Terms to reflect changes in the law, regulatory requirements, or improvements to our Services. When updates affect your use of the Services or your legal rights, we will notify you at least 30 days before the changes take effect. If you do not agree with the updated Terms, please cancel your account before they become effective.
